§ 18-5. Definitions.

  • Unless the context specifically indicates otherwise, the meaning of the terms used in the open burning ordinance shall be as follows:

    Bonfire means an outdoor fire utilized for ceremonial purposes.

    Campfire means a small outdoor fire intended for recreation or cooking but not including a fire intended for disposal of waste wood or refuse.

    Clean wood means natural wood which has not been painted, varnished or coated with a similar material; has not been pressure treated with preservatives, and does not contain resins or glues as in plywood or other composite wood products.

    Construction and demolition waste means building waste materials, including but not limited to waste shingles, insulation, lumber, treated wood, painted wood, wiring, plastics, packaging, and rubble that result from construction, remodeling, repair, and demolition operations on a house, commercial or industrial building, or other structure.

    Fire chief means the Chief of the Berrien Springs Oronoko Fire Department or other person designated by the fire chief.

    Fire department means the Berrien Springs Oronoko Fire Department.

    Fire suppression costs means all charges for each fire department vehicle, including but not limited to, pumpers, ladder trucks, tankers, rescue squads, brush units, command units and other vehicle, including Berrien Springs Oronoko Police Department vehicles. Hourly rates for these charges shall be established by resolution of the village council from time to time. Fire suppression costs also include charges incurred by the village for equipment and personnel not owned or employed by the village, but requested by the fire chief or incident commander for purposes of mitigating and suppressing the fire. Fire suppression costs shall also include personnel related expenses incurred by the village including but not limited to, salaries, fringe benefits, insurance for full time and part time personnel, overtime pay and related fringe benefit costs for hourly employees and fire run fees paid to on-call fire personnel. These personnel related expenses will commence when the fire department has begun responding to the fire and shall continue until fire department personnel have concluded responding to the fire.

    Municipality means a county, township, city or village.

    Open burning means kindling or maintaining a fire where the products of combustion are emitted directly into the ambient air without passing through a stack or a chimney. This includes burning in a burn barrel.

    Outdoor burning means open burning or burning in an outdoor wood-fired boiler or patio wood-burning unit.

    Outdoor wood-fired boiler means a wood-fired or pellet fire boiler, stove or furnace that is not located within a building intended for habitation by humans or domestic animals.

    Patio wood-burning unit means a chimney, patio warmer, or other portable wood-burning devise used for outdoor recreation and/or heating.

    Refuse means any waste material except trees, logs, stumps, leaves, grass clippings and other vegetative matter.
